HIPAA and PHI

Certain demographic, health, and/or health-connected information about the Users that Near Me Dental may collect in the course of providing access to the Service to the Healthcare Providers might be treated as the “protected health information” or “PHI” under the Health Insurance Portability and Accountability Act (“HIPAA”). When NMD operates as a “Business Associate” (as such term is defined in HIPAA) and receives personally identifiable information about a User from or on behalf of the Healthcare Provider, and such Healthcare Provider is a “Covered Entity” (as such term is defined in HIPAA), this data falls under the PHI regime. Private information that the Users provide to NMD beyond the aforementioned context is not PHI. For instance, the PHI regime does not apply when you set up an account or adopt our online devices and services, conduct a search of the Healthcare Providers or book appointments with the Healthcare Providers, complete common medical history forms that are not connected with a particular Healthcare Provider (“Medical History Forms”); User voluntarily provides information in free-form text boxes through the Services or replies to reviews and worksheets; Users posts surveys; provide mechanism/IP Information or Web Analytics material by looking through our websites https://nearmedental.com/ or email us or differently reach out to us directly, that information is not PHI.

Processing of Data of Underage Persons

The Service is not intended for the use of persons under sixteen years. When you access, work with, and/or submit any data to NMD, you confirm to us that you are older than sixteen age. Our Terms of Use and other NMD documentation contain specific wording stating that we do not specifically collect or process the Individual Data from persons below the age of sixteen. NMD recognizes that it collects or processes any Individual Data regarding a child under age sixteen without parents or guardians’ permission. NMD will use that Individual Data only to inform the child (the parents or guardian or other legal representatives) that the child is not authorized to use the Service. Controlling Your Individual Data & Notifications

Whenever you are a registered User of NMD, you may change certain Individual Data or other account information. If you would like to close your account, please email us at Privacy@NearMeDental.com. NMD will use reasonable efforts to delete your account as soon as possible. However, NMD reserves the right to keep information from closed accounts consistent with our internal data storage policies and requirements of applicable laws. You must immediately notify NMD if any of your account information is compromised, changed, stolen, or used in any other manner without your permission.

California Rights

The California Consumer Privacy Act of 2018 (“CCPA”) gives California residents with certain rights about their Individual Data.
